This page considers movement towards a droit de suite
regime in New Zealand.
It covers -
introduction
New Zealand has moved towards a national droit de suite
scheme in parallel with Australia.
The New Zealand Copyright (Artists’ Resale Right)
Amendment Bill was introduced in May 2008 and immediately
referred to the Government Administration Select Committee.
The expectation is that the legislation would establish
a royalty scheme for artworks resold on the secondary
art market. That scheme would be similar to Australia's,
assisting "suitable reciprocal arrangements"
when works are sold across the Tasman.
The New Zealand scheme would include -
- a
single collective
rights body to monitor and enforce the droit
- restrictions
on the scope of artists and "art market professionals"
(eg auction houses) to contract out of the scheme
- coverage
of a wide range of original artistic works, such as
paintings, limited edition prints, photographs, ceramics
and glassware
- coverage
during the artist’s lifetime and for up to 70
years after the artist's death
- a
flat 5% royalty rate

joint and several liability for royalty payment between
the seller and the art market professional
- potential
for international reciprocity.
